1. Acceptance of Terms
By creating an account or using the Klaus Auto platform ("Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Service. Klaus Auto Pty Ltd ABN [TBC] ("we", "us", "our") operates the Service.
2. Eligibility
You must be at least 18 years old and a resident of Australia to use the Service. By registering, you represent that the information you provide is accurate and complete.
3. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use.
4. Vehicle Information & Valuations
- Vehicle data including specifications, registration status, and valuations is sourced from third-party providers and government registries. We do not guarantee accuracy, completeness, or timeliness.
- Valuations are estimates only and should not be relied upon as a formal appraisal. Actual sale or trade-in prices may differ.
- By adding a vehicle, you confirm you are the registered owner or have the owner's authorisation.
5. Permitted Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law.
- Attempt to scrape, harvest, or programmatically access data from the Service without written consent.
- Impersonate another person or misrepresent vehicle ownership.
- Interfere with the security or integrity of the Service.
6. Intellectual Property
All content, branding, and software comprising the Service are owned by Klaus Auto or its licensors and are protected by Australian and international intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, Klaus Auto and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability is limited to the amount you paid us (if any) in the 12 months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.
8. Indemnification
You agree to indemnify and hold harmless Klaus Auto from any claims, losses, or damages arising from your breach of these Terms or misuse of the Service.
9. Termination
We may suspend or terminate your account at any time for breach of these Terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.
10. Changes to Terms
We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.
